La gestación por sustitución en Argentina no posee aún legislación. El Código Civil y Comercial de la nación en su apartado sobre filiación, presenta una contradicción entre sus artículos que deja a esta técnica, y por ende a sus usuarios, desamparados. Esta deuda jurídica representa, al modo del síntoma analítico, el debate sobre el estatuto de la gestante y la maternidad como efecto de la voluntad procreacional. Para el psicoanálisis el lugar de la madre como función y la experiencia de gestación, no se confunden. De manera que el analista, en su lectura clínica de la problemática, denuncia esta distancia y apuesta una intervención: nacer de otro y nacer de un Otro, no son equivalencias. This legal debt represents, as an analytical symptom, the debate on the status of the pregnant woman and maternity as an effect of the procrational will. For psychoanalysis the place the mother has as a function is differntiated to the gestation experience. This way the analyst, in his clinical reading of the issue points out this distance and bets on an intervention: to be born from another has more than one meaning.
