La ley 26.150 creó en 2006 el Programa de Educación Sexual Integral que reconoce el derecho a la educación sexual a través de un abordaje transversal e integral, el cual articula 5 ejes: la perspectiva de género, el respeto por la diversidad, el ejercicio de los derechos, la valoración de la afectividad, y el cuidado del cuerpo y la salud. Estos ejes centrales fueron promovidos e incluidos en la ley por los colectivos que los militan. Desde 2016 el gobierno desarrolla acciones y políticas de desmantelamiento y desfinanciamiento del programa ESI. El sistema educativo restringe los recursos materiales y profesionales. Desde los medios se duda de la efectividad y el alcance de la aplicación de la ley. Posturas retrógradas y “antiderechos” que atacan a la ESI son fomentadas desde organizaciones religiosas, políticas y educativas. Como respuesta a este vaciamiento y estos ataques se da una resistencia individual y colectiva, desde las instituciones educativas, las ONGs y los colectivos políticos involucrados. La ley dejó de sostenerse y aplicarse como tal, la lucha se renueva y vuelve al nivel anterior, son los propios sujetos individuales y colectivos quienes sostienen la resistencia y promueven los derechos en relación a la ESI. AGAINST NEOLIBERAL POLITICS OF EMPTYING AND EXCLUSION, TEACHERS AND STUDENTS FIGHT IN CLASSROOMS TO MAINTAIN AND ENLARGE THEIR RIGHTS National Argentinean Law 26.150 created in 2006 the Comprehensive Sexuality Education (CSE) Program, which recognizes students’ rights to sexual education throughout a traverse and integral learning frame, which articulates 5 core axes: gender perspective, respect for diversity, exercise of human rights, valuation of affectivity, and care of own body and health. These central axes were promoted and included in the law by the political organizations and communities that militate them. Since 2016 government develops actions and politics of dismantlement of CSE program. The educational system restricts material resources and professionals. Media is constantly doubting about the effectiveness and actual impact of the application of CSE Law and Program. Retrograde and “against-rights” postures, that constantly attack CSE, are fomented by religious, political and educational institutions. As an answer to this emptying and attacks individual and collective resistance has appeared, from educational institutions, from NGO and the involved political collectivities and communities. As Law stopped to be sustained and applied as such, the fight is renewed and returns to the previous level, individual and collective subjects are the ones who resist and promote the rights in relation to the CSE.
