El presente trabajo tuvo como propósito indagar sobre el cumplimiento de la Ley de Salud Mental (N° 26.657) en cuanto a la presentación del consentimiento informado (CI) en psicoterapia. De aquí derivó también el objetivo de examinar si las personas encuestadas reconocían la corriente terapéutica de su tratamiento y, de ser así, cuál fue la fuente de este conocimiento. Se realizó un estudio descriptivo de corte transversal y cuantitativo; utilizando un instrumento creado Ad-hoc en forma de formulario online. El muestreo fue intencional, no probabilístico, empleando la estrategia bola de nieve. De esta investigación se obtuvo que el 24,60% de la muestra no recibió información sobre la corriente terapéutica. Por otro lado, un 42,93% refirió no conocer sobre la obligatoriedad del CI en los tratamientos de Salud Mental; y un 29,84% no lo recibió. A su vez, se comparó la presentación del CI en terapias psicoanalíticas y en cognitivo conductuales y se obtuvo que, mientras en los tratamientos psicoanalíticos un 47,80% de los encuestados fueron informados sobre la corriente terapéutica, en los cognitivo-conductuales se informó en un 62,42%. Podría concluirse entonces que se está incumpliendo la Ley N° 26.657 en los espacios terapéuticos. Palabras clave Psicoética - Derechos del paciente - Consentimiento informado - Ética profesional ABSTRACT STUDY ON THE PRESENTATION OF INFORMED CONSENT IN THE MENTAL HEALTH FIELD IN BUENOS AIRES METROPOLITAN AREA (AMBA) This research studies the extent to which psychotherapists abide by Argentina’s current Mental Health Law regarding the presentation of informed consent (IC) to their patients. It also analyses whether Buenos Aires Metropolitan Area psychotherapy patients can identify the type of treatment they receive and the source of that knowledge. A descriptive, quantitative, cross-sectional study has been conducted using an online form created ad hoc to collect data. The sampling is intentional, non-probabilistic, and of the snowball type.The results obtained show that 24.60% of the sample have received no information about the specific type of treatment they are being given. In addition, 29.84% have never been introduced to IC, while 42.93% have never heard of the obligatory nature of IC in mental health treatments. Through a comparative analysis between participants receiving a therapy based on psychoanalysis and those receiving one based on cognitive-behaviourism, this study reveals that 47.80% of the former have been able to identify the type of treatment they receive, while the percentage amounts to 62,42% in the latter. All this leads to the conclusion that when it comes to IC within psychotherapies, Argentina’s current national mental health legislation has frequently been violated.
