De la fascinación del crimen al tratamiento judicial remite a dos espacios: el espacio de la captura del sujeto por el acto y el espacio de la institución judicial. Del uno al otro ocurre la pérdida de la significación y del sentido de quien se convierte en objeto de la captura institucional: el criminal. De la fascinación del crimen nos habla que lo real impacta en términos de la perplejidad que deja al sujeto frente al escenario del acto, allí surge la fascinación. El crimen fascina porque designifica al sujeto, lo captura en una propuesta de goce. Mientras que el tratamiento psicoanalítico irrealiza el crimen y humaniza al criminal, en los tratamientos judiciales se realiza el crimen y su autor. Lo real del crimen adquiere estatura institucional: el derecho dice al criminal de su serlo. El crimen fascina porque ofrece lo no representable, lo atroz, aquello que no se debe (ha/ser) desde el lado del sujeto y lo que no debe ser siendo desde el lado de la institución judicial. El psicoanalista no cederá ante la fascinación e interrogará por ella tratando que el fascinadopuedairrealizareseobjeto.Elcrimen,allí,evanescerá como realidad sociológica y tomará irrealidad sujetiva. Palabras clave Sujeto Crimen Derecho Psicoanalisis ABSTRACT FROM THE FASCINATION OF CRIME TO JUDICIAL TREATMENT From the fascination of crime to judicial treatment refers to two areas: the capture of the subject by the act and the judicial institution. From one to the other there is a loss of the significance of the one who becomes the object of the institutional capture: the criminal. From the fascination of crime tells us that what is real has an impact in terms of the perplexity that leaves the subject in the face of the scenario of the act, there fascination appears. While psychoanalytical treatment irrealizes crime and humanises the criminal, in judicial treatments crime and its author are realized. What is real about the crime takes on an institutional stature: the law tells the criminal about his being so. Crime fascinates because it offers what cannot be represented, what is atrocious, that which must not (be/done) from the point of view of the subject and what must not be being from the point of view of the judicial institution. The psychoanalyst shall not succumb to the fascination and shall question for it, trying to make the fascinated one able to irrealize that object.
