Se presenta aquí, un recorte de una investigación mayor, titulada: “De la bioética a la biopolítica. Construcciones discursivas, dilemas actuales sobre el cuerpo, el arte, la ciencia y la subjetividad de hoy”. Dicha investigación se sustenta, además en los aportes del campo teórico que aborda a la Biopolitca, y la teoría psicoanalítica, fundamentalmente, lacaniana. Este avance surge a partir de interrogar la relación entre la nueva ley de identidad de género, aprobada en nuestro país recientemente, y el Manual Diagnóstico de Enfermedades Mentales (DSM-V), a la espera de su puesta en vigencia a partir del 2013. Se procura explorar, en el marco de esta ley, que lugar ocupará el cuerpo para el sistema médico, regido por el manual diagnóstico de enfermedades mentales (DSM-IV y futuro DSM-V), donde se considera a la transexualidad y al travestismo como un trastorno de la identidad sexual y de genero; además nos preguntamos si es posible que la nueva ley actúe en esta nomenclatura, ya que la misma despatologiza dichas identidades sexuales. De este modo, se indagará la despatologización que la nueva ley establece, sus alcances y las posibles consecuencias en la intervención de los cuerpos dentro del sistema de salud. GENDER IDENTITY LAW AND DESPATHOLOGIZATION Here comes a part of a larger research, titled: “Discursive constructions, actual dilemmas about the body, the art, the science and today´s subjectivity”. This investigation is sustained, besides, in the contribution of the theoretical field that approaches the biopolitics and the psychoanalytic, fundamentally, Lacanian´s. This advance appears asking the relation between the new gender identity law, recently approved in our country and the Diagnostic and Statistical Manual of Mental Disorders (DSM-5), to the wait of its putting in force since 2013. It is tried to explore, inside this law, which place will occupy the body to the medical system, governed by the Manual of Mental Disorders (DSM-IV and future DSM-V), where the transgender and transvestism is considered as a disorder of the sexual identity and genre; besides,we asked if it is possible that the new law acts in this nomenclature because it despathologizes those sexual identities. Thus, it will wonder the des pathologization that the new law establishes, its scopes and the possible consequences in the bodies’ intervention within the health system.
