El objetivo del presente trabajo es visibilizar y problematizar la vulnerabilidad de derechos humanos en personas trans, a quienes hasta hace poco tiempo les era negado el reconocimiento de su identidad y, en consecuencia, de sus derechos humanos fundamentales. Se sostiene como núcleo del trabajo que la negativa del Estado argentino al reconocimiento de estas identidades tuvo que ver con la criminalización, la estigmatización y la patologización que se ha hecho de ella en el imaginario colectivo,sostenido principalmente por los discursos dominantes de la psiquiatría, el derecho, la medicina, la filosofía, la religión y los medios de comunicación hegemónicos; basados en los pensamientos heteronormativos y dicotómicos. Asimismo,debidoalarecientepromulgacióndelaLeydeIdentidadde género, se señalan los aspectos más importantes de dicha normativa y los nuevos desafíos que plantea en la actualidad a la sociedad y al Estado argentino, para generar políticas públicas que terminen con la discriminación y se orienten hacia una mayor inclusión social y respeto por la diversidad, promoviendo el acceso a la educación, a la salud, a la vivienda y a un empleo digno. Abstract VULNERABILITY OF HUMAN RIGHTS IN TRANS PERSONS It is the purpose of the present paper to investigate and thus, demonstrate the vulnerability of human rights in trans people, whose recognition of their identity has been neglected until this year.And as a consequence their fundamental human rights have been neglected, too. Firstly, one may state that denial of the argentine state to the recognition of these identities might have been closely related to the “criminalization”, the “stigmatization” and the “pathologization” that has been made to itself in the imaginary group, supported, mainly, by the dominant speeches of psychiatrists, the law, the medicine, the philosophy, the religion and hegemonic mass media; based on the binaries and heterosexual rules. However, due to the recent promulgation of the law of identity of gender, there are many important aspects of the above mentioned regulation to be listed and there are new challenges for the society and the argentine state to face. There is a need to generate public policies that end with discrimination and lead to major social incorporation and respect for gender diversity, promoting everyone’s access to education, health, housing and a worthy employment.
