Las múltiples investigaciones sobre los efectos subjetivos del acto de testimoniar en los juicios por crímenes de lesa humanidad durante la última dictadura militar argentina en los testigos-víctimas, surgen a partir de la preocupación por las condiciones en que éstos prestan su palabra en la escena jurídica. Una de las conclusiones centrales y consensuadas es que las coordenadas en las que un testigo realiza una declaración funcionan como condiciones para que la acción de testimoniar tenga al menos dos destinos posibles: por un lado, el que intentamos promover desde el campo de las ciencias humanas, la producción de un testimonio; y por otro, un destino mortífero, la promoción del silencio que perpetua la posición de víctima en lugar de causar la palabra, única vía posible para romper esa identidad sufriente. El presente trabajo se centrará en el rol del Estado como creador de condiciones que posibiliten el proceso de subjetivación que inicia la construcción de un testimonio. Y concluye con una inquietud sobre la suficiencia de la escena jurídica en la producción de un testimonio en su estatuto singular. Nos auxiliará en esta tarea un recorrido conceptual que se enmarca en el campo filosófico. Palabras clave Sujeto, Estado, Testimonio, Relato ABSTRACT ABOUT POLITICAL INSTANCE IN TESTIMONY Multiple research on the subjective effects of the act of witness in trials for crimes against humanity during Argentina’s military dictatorship in the victim-witnesses, arise from concerns about the conditions in which they give their word on the legal scene . One of the central and agreed conclusions is that the coordinates where a witness makes a statement function as conditions for action witness has at least two possible destinations: on the one hand, we try to promote from the field of human sciences , production of a witness; and secondly, a deadly fate, promotion of silence that perpetuates the position of victim rather than causing the word, only possible way to break that suffering identity.
