El presente trabajo se incluye en el marco de la investigación “Las afecciones narcisísticas no psicóticas” del Programa de Fomento a la Investigación de la Facultad de Psicología de la UBA (PROINPSI Res. CD N 902/11). Realizaremos un recorrido de los aspectos fundamentales de la Ley N 26743, sancionada en Argentina en mayo del 2012, relativa a la Identidad de Género y su relación con otras leyes: Salud Mental, Protección integral de los Niños y Adolescentes, Matrimonio Igualitario. Entendiendo la Ley como un instrumento surgido de la Política. Asimismo, se comparará con Leyes de otros países y se pondrá en debate con el discurso Psicoanalítico respecto de la lógica en juego en la asunción de un sexo sosteniendo la tensión que puede implicar las relaciones entre el Derecho y su Envés (alusión al seminario de Lacan, “El Envés del Psicoanálisis”).Tomaremos textos cinematográficos referidos a personas que desean un sexo diferente del que fue inscripto al nacer. Se presentará un viñeta clínica. Se indagará finalmente el valor jurídico de la diferencia de los sexos y cuál es la incidencia del discurso jurídico en los sujetos. Palabras clave Políticas, Psicoanálisis del Derecho al Envés ABSTRACT POLITICS AND PSYCHOANALISIS: THE RIGHT TO UNDERSIDE This work is included as part of the investigation “Non narcissistic psychotic disorders” Programme for the Promotion of Research at the Faculty of Psychology of the UBA (PROINPSI Res CD N 902/11). We’ll make a tour of the fundamental aspects of the Law No. 26743, enacted in Argentina in May 2012 on Gender Identity and its relationship with other laws: Mental Health, Integral Protection of Children and Adolescent , Equal Marriage. Understanding the law as an instrument emerged from politics. Also it’s compared to laws of other countries and it will debate the Psychoanalytic discourse about the logic involved in the assumption of a sex holding the tension that may involve the relationship between the law and its Underside (allusion to the seminar Lacan “The underside of Psychoanalysis”). We will use film texts referring to people who wish for a different from the one that was registered at birth. One clinical vignette is presented. We will finally inquire the legal value of the difference of sexes, and what is the incidence of legal discourse on the subject. Key words POLITICS AND PSYCHOANALISIS: THE RIGHT TO UNDERSIDE
