Partiendo del supuesto de que el ritual jurídico puede eventualmente cumplir una función simbólica en la tramitación del duelo por parte los familiares de desaparecidos durante la última dictadura militar en Argentina, el presente trabajo se propone indagar la relación existente entre el proceso de duelo atravesado por ellos, proceso que se vio dificultado por la ausencia del ritual funerario, y el acto de testimoniar en las causas abiertas por violaciones sistemáticas a los derechos humanos, así como también si este ritual jurídico puede compensar la falta del ritual funerario o acaso resultar perjudicial. Para ello se relevará información bibliográfica, de investigaciones previas y se entrevistará a los equipos técnicos que prestaron asistencia a los testigos, para así describir el proceso de brindar testimonio en los juicios, así como también se realizará un análisis teórico de las condiciones que atañen a la elaboración de un proceso de duelo con el objetivo de establecer los efectos subjetivos de dicho testimonio en los testigos. RELATIVES OF DISAPPEARED PERSONS WHO TESTIFY IN TRIALS FOR CRIMES AGAINST HUMANITY Based on the assumption that the juridical ritual may eventually fulfill a symbolic function on the grief elaboration by those whose relatives were disappeared during the last military dictatorship in Argentina, the aim of this work is to study the relation between the mourning process they have been through, which had been obstructed by the absence of a funerary ritual, and the act of testifying in trials for human rights violations, as well as to explore if this testimony might compensate for the lack of the funeral ritual, or if it might actually be harmful. To this end, a preliminary research will be carried out by interviewing the technical teams who assisted the witnesses, from bibliographic sources and from previous investigations on this topic, so as to describe the process of testifying in trials. Furthermore, a theoretical analysis will take place around the mourning process conditions in order to determine the subjective effects of testimony on witnesses.
