El bullying es un fenómeno social que ha trascendido los ladrillos de las instituciones educativas, a través del uso de internet en dispositivos móviles. El fenómeno del bullying interpela a las escuelas, familias y a todos los miembros de la sociedad, debido a las consecuencias dañinas e irreparables que produce en los niños que viven bajo el sistema bullying. El término “sistema bullying” da cuenta del carácter relacional del fenómeno, evidenciando la existencia de diversos actores intervinientes. El carácter ubicuo y la viralidad con que se replican los datos a través de internet, ponen de manifiesto la imposibilidad de resolver el problema mediante acciones aisladas. (Patchin & Hinduja, 2014). La ley 26.892, de convivencia y abordaje de la conflictividad en las instituciones educativas, sancionada en Argentina en 2013, tiene por objetivo hacer visible el problema del bullying, involucrando a los adultos, convocándolos a tomar un rol activo en el trabajo junto a la escuela, en prevención, elaboración de proyectos de convivencia y de sanciones conjuntas. En este trabajo se desarrolló un análisis crítico de las posibilidades y límites de la ley, enfatizándose la necesidad del trabajo en concientización y prevención como pre-requisito al trabajo de cada institución educativa. Bullying phenomena challenges schools, families and society because of the harmful and irreparable consequences for children who suffer from bullying. The “bullying system” is a term used to emphasize the relational nature of the phenomenon and it highlights the existence of the diverse actors involved. The ubiquitous and viral nature of data replicating over the internet means that it is impossible to solve the bullying problem through isolated actions. (Patchin & Hinduja, 2014). In 2013,Argentina passed a new law (No 26.892) that promotes coexistence and dispute resolution in educational institutions. The law’s purpose is to highlight the problem of bullying. The law also intends that adults will take an active role in their school communities, including participating in bullying prevention and developing penalties for bullying behavior. This work provides a critical analysis of the limitations of the 26.892 Law, emphasizing the need for educational institutions’ to develop a deep awareness of, and prevention strategies for, bullying.
