Este artigo focaliza o processo histórico da criança e do adolescente no mundo moderno, principalmente no Brasil. Destacamos a temática dessa população no que tange à promoção de seus direitos, pois o Brasil foi o primeiro país da América Latina a ter uma legislação bem construída nessa área. Porém, certas falhas existiram no passado, havendo uma evolução gradual através das diversas constituições pelas quais já passamos. Fizemos um retrospecto desde o século XVI na Europa, onde crianças e adolescentes eram tratados como objetos, passando pelo século XVIII, quer dizer, mais ou menos 200 anos, quando se iniciaram as preocupações com a própria presença e com a existência desses sujeitos, até os dias atuais, onde passaram a ser visto com outros olhares e sendo tratados como sujeitos de direitos. Ao longo da história, aferimos que o desgastado modelo da doutrina de situação irregular foi substituído pelo enfoque da proteção integral. We detail the whole of this population in the promotion of its right, because Brazil were first country of American Latine to have a very good constrution in this space. However, any faults existent in the last time, having a gradual evolution in constitution. Carring foward (in retrospect) since XVIII th century whether more or less 200 years a go when the anxiety begginning with the own presence and the existence of these questions, till ours days where now they are differently seen and treated as wrail subjects.
