La Probation o Suspensión del Juicio a Prueba es la más importante medida alternativa a la privación de la libertad que se aplica en Argentina. La eficacia subjetiva y social de su implementación depende de dos factores articulados: (1) el efecto de sanción que tenga para quienes se benefician de la medida, y (2) el grado de comprensión y aceptación social que exista sobre la iniciativa. El presente trabajo discute una metodología original exploratoria para estudiar el segundo de estos factores: la sensibilidad de distintos sectores sociales frente a la Probation. En esta primera etapa el foco está puesto en la población universitaria, por ser la que ha accedido al máximo nivel de conocimiento disponible, y de la que se espera una mayor sensibilidad sobre el tema. En la primera parte se presenta un diagnóstico de la situación carcelaria y un fundamento de la importancia de la Probation desde el punto de vista de los Derechos Humanos. En la segunda parte se presenta la metodología general de la investigación y se analiza una de las viñetas que integra el instrumento, adelantando algunos datos que evidencian su capacidad para estimar el sistema de representaciones sociales sobre los delitos y las penas. Palabras clave Probation Derechos Humanos Delito Representaciones Sociales ABSTRACT PROBATION AND SOCIAL REPRESENTATIONS ON THE CRIMES AND PUNISHMENTS: DESIGN OF AN EXPLORATORY INSTRUMENT FOR DIAGNOSTIC EVALUATION Probation is the most important alternative measure to the privation of the freedom that is applied in Argentina. The subjective and social efficiency of its implementation depends on two articulated factors: (1) the effect of sanction that has for those who benefit from the measure, and (2) the degree of comprehension and social acceptance that exists on the initiative. The present work discusses an original exploratory methodology to study the second one of these factors: the sensitivity of different social sectors opposite to the Probation. In this first stage the area is put on the university population, for being the one that has acceded to the maximum level of available knowledge, and from that a major sensitivity is expected on the topic. In the first part of this paper diagnosis of prison situation and a foundation of the importance of the Probation from the point of view of the Human rights are presented. In the second part general methodology of the research is presented with the analysis of one of the situations that integrates the instrument, advancing some information that demonstrate its aptitude to estimate the system of social representations on the crimes and punishments.
