Este trabajo se propondrá el análisis de la prohibición del incesto, puntualizando la importancia que éste tiene en la estructuración de la sociedad y la subjetividad. Se utilizará las consideraciones teóricas del antropólogo Claude Lévis-Strauss y de Pierre Legendre, jurista y psicoanalista francés. Abordaremos la pregunta ¿Qué instaura la prohibición del Incesto? Descubriendo la complejidad de la problemática del poder, el deseo, la reproducción y la diferenciación. Conceptos insistentemente negados por las instituciones sociales y los sujetos, que se obstinan en creer ciegamente, en la inocencia de las relaciones intra-familiares. Inocencia que permite velar las estructuras de poder y la compleja trama del deseo que se atrincheran en ella. Poder del padre, que según el Estado, debe estar acotado y no puede abusar del cuerpo del otro, del niño. La transmisión de esta prohibición se hace a través de la genealogía. Lo que se transmite es la imposibilidad de la indiferenciación, si queremos ser humanos. Es la lógica de la diferencia, esencial para poder reproducir a un semejante. Un sujeto asujetado al lenguaje y la ley jurídica y social. Intentaremos indagar las consecuencias de los casos de incesto paterno-filial, donde un adulto hace declinar la ley que debe sostener para producir a un sujeto.
