Este trabajo se propone rastrear la legislación vigente en salud mental (a nivel internacional y local) en la provincia de Buenos Aires con el fin de analizar su articulación, en tanto posibilidades y obstáculos, con las transformaciones que se proponen en los modelos de atención. Esto constituye un objetivo macrocontextual de la tesis doctoral de la autora, que se propone indagar cómo y en qué condiciones realizan sus derechos las personas que han estado internadas en instituciones psiquiátricas y han sido declaradas incapaces luego de haber atravesado un juicio de insania, una vez que retornan a sus comunidades de origen, para ser tratadas en programas comunitarios de salud mental cuyos objetivos son el restablecimiento de las redes sociales y la restitución de derechos. BETWEEN OBJECTS OF PROTECTION AND SUBJECTS OF RIGHTS This paper aims to describe the mental health legislation (international and local) in Buenos Aires province in order to analyze its relationship, such as opportunities and as obstacles, with the changes to be made in the care system. This is a macro contextual objective of the author’s doctoral thesis, which aims to investigate how and in which conditions, people who have been interned in psychiatric institutions and have been declared incapable after going through a trial of insanity, carry out their rights, once they return to their communities to be treated in community mental health programs which objectives are the restoration of social networks and the restitution of their rights.
