En estos tiempos de globalización panóptica, el gran ojo, como metáfora del Otro absoluto (e imposible) ilumina segmentadamente el mapa del crimen, encandilando a su presa de turno: en estos días los pibes que delinquen. Nominación que prefiero a la de niños y púberes, ya que me interesa subrayar que ellos están en el tiempo en el que no corresponde que se hagan cargo de sí mismos. Los proyectos de ley que debate la Comisión pertinente en las distintas cámaras tienen posturas más o menos punitivas, pero entre la culpa o la responsabilidad por el delito cometido, nadie acompaña las iniciativas de una nueva legislación, con proyectos que interroguen la responsabilidad que tienen las diferentes instituciones con esos pibes. Instituciones que, tradicionalmente, tenían a su cargo la función instituyente de la subjetividad, por ejemplo la familia, la escuela y por supuesto el estado. No se trata sólo de penalizar a ese segmento poblacional como a los adultos, ni tampoco de penalizarlos como niños. Ambas posiciones argumentan a su favor que el encierro será conforme a una ley, por lo tanto sujetos al derecho de un juicio y su correspondiente defensa. Se trata también de revisar la categoría de niño. I prefer the nomination of pubescent boys, due to I really want to encourage the idea thar the difference between a kid and an adult is that they are unable to take charge of themselves. Bills Committee that handle the relevant discussion on the various cameras have a more or less punitive direction. Kids are guilty or responsible for the crime committed, but no one of the projects follows the initiatives of new legislation, contemplating the responsibility of the these kids with the responsability of the different institutions. Institutions that traditionally were responsible for instituting the role of subjectivity, such as family, school and of course the state. The problem is that changing the law (penalize this segment of the population as well as adults, or as children) in both positions the main argument is in favor of the enclosure, of course, with the bennefits of the law (trial a defense).
