El campo de intervención del psicólogo en temas de psicología forense permanentemente encuentra nuevos espacios para el abordaje de las problemáticas que plantean las modificaciones que el mundo actual nos presenta. La probation, como medida alternativa a la privación de libertad, es uno de ellos. En el desarrollo de la tarea encontramos dos conceptos ineludibles: la responsabilidad subjetiva y la corresponsabilidad social. Se trata de términos que surgen únicamente en el entendimiento de la disciplina como eminentemente comunitaria: la eficacia de la medida sólo es posible en el encuentro del viraje subjetivo y el acompañamiento por parte de la comunidad al sujeto. Así es que el concepto de corresponsabilidad social adquiere relevancia para el estudio cabal del instituto de la probation. El éxito de la medida dependerá en gran parte del modo en que la propia comunidad que generó al sujeto lo reciba y contenga al momento de ejecución del acto ilícito. Probation, as an alternative to imprisonment, is one of them. Two concepts are essential to the development of the work: social co-responsibility and responsibility. These terms only arise from the understanding of the discipline as essentially communal: the action’s effectiveness is only possible if there is an encounter between the subjective and the accompanying shift from the community to the subject. Therefore, the concept of social co-responsibility is relevant to the thorough study of the institute of probation. The success of the measure will largely depend on how the same community which generated the subject receives and contains the instance of execution of the wrongful act.
