El presente trabajo propone una serie de reflexiones con base en el texto de la Ley 26657 (Derecho a la protección de la Salud Mental), a partir de los aportes teóricos propuestos desde la llamada “bioética de protección” (F. Schramm et al.). Dicha reflexión intenta, por una parte, revisar las nociones de cuidado y protección involucradas en el texto de dicha norma, con el consabido cambio de paradigma frente al complejo campo de la salud mental que allí se plantea. Por otra parte, se intentan revisar algunos desarrollos teóricos dentro del campo de la bioética, como la noción de “bioética de protección” planteada en el ámbito de debate de algunos autores latinoamericanos, a la luz de los desafíos y particularidades que presenta esta región (y asimismo cada país que la integra) en el marco de las políticas públicas en salud como temática integral. Este escrito pretende ofrecer algunos puntos de partida y retomar debates sobre un tema de urgente actualidad en nuestras sociedades. Palabras clave Ley - Salud mental - Bioética - Protección ABSTRACT ETHICS AND MENTAL HEALTH: SOME REFLECTIONS ON THE NATIONAL MENTAL HEALTH LAW FROM THE BIOETHICS OF PROTECTION This paper proposes a series of reflections based on the text of Law 26657 (Right to the protection of Mental Health), based on the theoretical contributions proposed from the so-called “bioethics of protection” (F. Schramm et al.). This reflection attempts, on the one hand, to review the notions of care and protection involved in the text of said standard, with the well-known paradigm shift in the face of the complex field of mental health that arises there. On the other hand, we try to review some theoretical developments within the field of bioethics, such as the notion of “bioethics of protection” raised in the field of debate of some Latin American authors, in light of the challenges and particularities presented by this region (and also each country that integrates it) in the framework of public policies in health as an integral theme.
