La intervención en Abuso Sexual requiere de un minucioso análisis de la constelación ético-psico-jurídica que la atraviesa. Tal circunstancia, hace que más allá de los informes que se realizan sobre cada caso evaluado, se abran cuestionamientos que compelen al conocimiento científico para su estudio. La línea de este trabajo desarrolla los aspectos inherentes a las vivencias traumáticas que los procesos judiciales pueden agravar, siendo la dimensión de la víctima, la que ha dado lugar a esta presentación. Sabido es que, el abuso sexual, causa efectos altamente traumáticos en la psiquis de la víctima y que por su característica en muchas ocasiones el testimonio de esta adquiere preeminencia al momento de probar los hechos. Por tanto, la ponderación de la víctima implica su protección especial con el fin de evitar que su participación en el proceso penal ocasione un daño adicional. El accionar ético le impone al perito psicólogo dar limite a las acciones judiciales que requieren su experticia, absteniéndose de intervenciones reiteradas y por tanto iatrogénicas, en aquellos casos en que detecte o estime que tales acciones perpetúan los procesos de victimización a través de innúmeras medidas probatorias que colocan al niño como “muestra” del delito bajo un “microscopio legal”. Palabras clave Abuso sexual - Proceso judicial - victimización - Etica ABSTRACT TRAUMATIC EFFECTS OF THE JUDICIAL PROCESS ON VICTIMS OF SEXUAL ABUSE The intervention in Sexual Abuse requires a careful analysis of the ethical-psycho-legal constellation that crosses it. Such circumstance makes that beyond the reports that are made on each case evaluated, questions are opened that compel scientific knowledge to study it. The line of this work develops the inherent aspects of traumatic experiences that judicial processes can aggravate, being the dimension of the victim, which has given rise to this presentation. It is known that sexual abuse causes highly traumatic effects on the victim’s psyche and that due to its characteristics, on many occasions, the victim’s testimony acquires pre-eminence when proving the facts. Therefore, the weighting of the victim implies their special protection in order to prevent their participation in the criminal process from causing additional damage. Ethical action imposes on the expert psychologist to limit the legal actions that require his expertise, refraining from repeated and therefore iatrogenic interventions, in those cases in which he detects or estimates that such actions perpetuate the processes of victimization through innumerable evidentiary measures that place the child as a “sample” of the crime under a “legal microscope”.
